These Terms of Service (“Terms”) govern your access to and use of the Ripped Cards website, online store, and related services.

Throughout these Terms, “Ripped Cards,” “we,” “us,” and “our” refer to Ripped Cards.

By visiting our website, creating an account, submitting information, or purchasing a product, you agree to be bound by these Terms. Please do not use the website or place an order if you do not agree to these Terms.

1. About Ripped Cards

Ripped Cards sells sports cards, trading cards, collectibles, autographed merchandise, sports memorabilia, and related products online.

Products may be owned directly by Ripped Cards or offered for sale on behalf of third-party owners through consignment arrangements.

Consignment services, collection purchases, card submissions, and other specialized services may be governed by a separate written agreement.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to make a purchase through our website.

Purchases for anyone under 18 must be completed by a parent or legal guardian.

By placing an order, you represent that the information you provide is accurate and that you are authorized to use the selected payment method.

3. Product Availability

Many sports cards and collectibles are unique, limited in quantity, or available as a single item.

Placing a product in your shopping cart does not reserve the product. A product may be purchased by another customer before you complete checkout.

All products are subject to availability. We may limit quantities, discontinue products, or cancel an order when a product is unavailable.

4. Product Descriptions and Photographs

We make reasonable efforts to describe and photograph our products accurately. However:

Colors may appear differently depending on your screen, lighting, or device.

Photographs may not reveal every scratch, mark, crease, dent, surface issue, print defect, stain, or other condition detail.

Product information may be based on available records, manufacturer information, third-party databases, or information supplied by a consignor.

Minor typographical, photographic, or listing errors may occur.

You are responsible for reviewing the complete product description, photographs, grading information, authentication information, and disclosed condition details before making a purchase.

If you have a question about a product, please contact us before placing your order.

If we discover a material error in a listing before shipment, we may cancel the order and provide a full refund.

5. Card Condition

Unless a listing specifically states that a card has been professionally graded, the card is sold as an ungraded or “raw” card.

Any statement made by Ripped Cards regarding the possible condition or grade of an ungraded card represents an opinion only. It is not a guarantee that a professional grading company will assign the same grade or any particular grade.

Condition standards can vary between collectors, buyers, sellers, and professional grading companies.

Normal manufacturing defects may include:

Off-centering;

Print lines;

Surface marks;

Edge wear;

Corner wear;

Wax stains;

Printing defects;

Factory scratches; and

Other production-related imperfections.

You should carefully review all available photographs before purchasing an ungraded card.

6. Professionally Graded Cards

Professionally graded cards are sold in the grading holder in which they were received by Ripped Cards.

The grade, description, authenticity determination, and label information belong to the applicable third-party grading company. Ripped Cards does not control the decisions or standards of grading companies.

Ripped Cards is not responsible for:

Differences of opinion regarding a third-party grade;

Changes in grading-company standards;

Population-report changes;

Label errors made by the grading company;

A grading company’s refusal to reholder, regrade, cross-grade, or authenticate an item; or

A different grade being assigned after a card is removed from its holder or resubmitted.

Any visible damage to a grading holder will be disclosed when reasonably noticeable. Minor scratches or ordinary wear to a holder may not be separately identified.

A card removed from its graded holder cannot be returned.

7. Autographs and Memorabilia

Autographed or game-used merchandise may include authentication from a third-party authentication company.

The product listing will identify any certificate of authenticity, letter of authenticity, serial-numbered hologram, witness certification, or other authentication included with the item.

Unless specifically stated in the listing, Ripped Cards does not independently guarantee:

That an autograph is authentic;

That an item was used in a particular game;

That an item was worn by a particular athlete;

That an item came from a particular event; or

That a third-party authentication company will authenticate the item in the future.

Any certificate, letter, hologram, or authentication document included with the product must remain with the product and must be returned with it if a return is approved.

8. No Affiliation With Leagues or Athletes

Unless specifically stated otherwise, Ripped Cards is not affiliated with, endorsed by, or sponsored by any:

Athlete;

Team;

Sports league;

Card manufacturer;

Grading company;

Authentication company; or

Entertainment organization.

All third-party names, trademarks, team logos, card designs, and athlete images belong to their respective owners.

9. Prices

All prices are shown in U.S. dollars unless otherwise stated.

Prices, discounts, promotions, and product availability may change without notice.

We may correct pricing, description, or listing errors at any time. If an error affects an order that has already been placed, we may cancel the affected order and issue a full refund.

An incorrect price caused by a website error, technical problem, typographical mistake, or unauthorized alteration does not require us to complete the sale at that price.

10. Orders

Submitting an order constitutes an offer to purchase the selected products.

We may accept, reject, limit, or cancel an order for reasons including:

Product unavailability;

Pricing or listing errors;

Incorrect billing or shipping information;

Suspected fraud;

Unauthorized payment;

Previous fraudulent or abusive conduct;

Resale concerns;

Violation of these Terms; or

Restrictions imposed by a payment processor, carrier, insurer, or applicable law.

An order is not final until we accept it and provide confirmation or ship the product.

If we cancel an order after payment has been collected, we will refund the amount paid for the canceled product.

11. Payment

You authorize Ripped Cards and its third-party payment processors to charge the payment method supplied at checkout for:

The purchase price;

Applicable sales tax;

Shipping charges;

Insurance charges, when applicable; and

Any other fees clearly disclosed before checkout.

You represent that you are authorized to use the payment method submitted with your order.

We do not directly control the processing times, authorization decisions, fraud reviews, or refund-processing times of banks, card issuers, or payment processors.

12. Sales Tax and Other Charges

Applicable sales tax will be calculated and collected when required by law.

You are responsible for any use tax, customs duty, import charge, brokerage fee, or similar obligation that is not collected during checkout.

International customers are responsible for determining whether a product may legally be imported into their country.

13. Shipping Information

Orders will be shipped to the address provided during checkout.

You are responsible for confirming that your shipping address is complete and accurate before submitting an order.

Ripped Cards is not responsible for delays, additional charges, or failed delivery caused by an incorrect or incomplete address supplied by the customer.

Please contact us immediately if you discover an address error. We cannot guarantee that an address can be changed after an order has been submitted.

14. Shipping Time

Any delivery date or shipping time shown on the website is an estimate unless expressly identified as guaranteed.

Shipping and delivery may be affected by:

Carrier delays;

Weather;

Holidays;

Natural disasters;

Incorrect addresses;

Customs inspections;

Labor interruptions;

Security reviews; or

Circumstances outside our reasonable control.

If no shipping period is stated, we will ship within the period required by applicable law.

If we cannot ship within the promised or legally required period, we will provide any delay notice, cancellation opportunity, consent request, or refund required by applicable law.

15. Tracking and Delivery

When available, tracking information will be sent to the email address or account associated with the order.

An order will generally be considered delivered when the carrier’s tracking records show delivery to:

The shipping address;

A mailbox;

A parcel locker;

A reception area;

A front desk;

An authorized pickup location; or

Another location selected or approved by the customer or carrier.

You are responsible for providing a secure delivery location.

If tracking shows delivery but you cannot locate the package, you should promptly:

Check the delivery area and mailbox;

Ask household members, neighbors, reception staff, or building management;

Contact the carrier; and

Contact Ripped Cards.

16. Lost or Stolen Packages

Please contact us promptly if a shipment appears to be lost.

We may require you to cooperate with a carrier, insurer, payment processor, or law-enforcement investigation.

When appropriate, we may:

Open a carrier claim;

Request additional documentation;

Issue a replacement when an identical product is available;

Provide store credit;

Issue a refund; or

Provide another resolution required by law.

Because many collectibles are unique, an identical replacement may not be available.

Ripped Cards is not responsible for theft or loss occurring after confirmed delivery, except where responsibility cannot legally be excluded.

17. Damaged Shipments

You must contact us promptly if a product arrives damaged.

To evaluate a damage claim, we may require:

Photographs of the product;

Photographs of the shipping box or envelope;

Photographs of all packing materials;

A photograph of the shipping label;

A description of the damage; and

Return of the product and original packaging.

Do not discard the product, shipping container, label, or packing materials until the claim has been resolved.

Failure to retain the packaging or provide requested information may prevent us or the carrier from processing the claim.

18. Returns

Unless a product listing states that the item is final sale, you may request a return within [NUMBER OF DAYS] days after confirmed delivery.

A return is not authorized until Ripped Cards approves the return and provides return instructions.

To qualify for a return:

The product must be returned in the same condition in which it was received;

The product must not have been altered, damaged, cleaned, repaired, opened, switched, or modified;

A graded card must remain in its original grading holder;

Sealed merchandise must remain sealed;

Certificates, authentication documents, accessories, and original packaging must be included; and

The product must be shipped according to the return instructions provided by Ripped Cards.

We may refuse a return that does not meet these requirements.

Nothing in this section limits any return or refund right that cannot legally be waived.

19. Final-Sale Products

The following products may be identified as final sale and may not be returned unless damaged, materially misdescribed, incorrectly shipped, or otherwise returnable under applicable law:

Auction purchases;

Break purchases;

Mystery products;

Personalized or customized products;

Opened packs or boxes;

Opened sealed products;

Redemption cards or redemption codes;

Digital products;

Products sold “as is”;

Products purchased during a final-sale promotion;

Products removed from a graded holder;

Products submitted for regrading or authentication after purchase; and

Products altered after delivery.

Any final-sale status will be disclosed in the product listing or before checkout.

20. Return Shipping

Unless the return is caused by our error, the customer is responsible for return shipping expenses.

We strongly recommend using a trackable and adequately insured shipping method. The customer is responsible for the returned product until it is delivered to Ripped Cards.

If a product was materially misdescribed, damaged before delivery, or incorrectly shipped, Ripped Cards will provide any return-shipping reimbursement required by law or approved by us.

Original shipping charges are generally nonrefundable unless the return resulted from our error or applicable law requires otherwise.

21. Refunds

Approved refunds will generally be issued to the original payment method after the returned product has been received and inspected.

We may reduce or deny a refund if the product:

Is returned in a different condition;

Is missing an included item;

Has been altered or damaged;

Has been switched for another product;

Is returned without authorization; or

Does not comply with the return instructions.

Processing times after a refund is issued depend on the customer’s bank, card issuer, or payment provider.

22. Order Cancellations

You may request cancellation before an order ships, but cancellation is not guaranteed.

Once an order has shipped, it must be handled under the applicable return procedures.

We may cancel an order at any time before shipment for reasons including product unavailability, listing errors, payment issues, suspected fraud, or violation of these Terms.

If we cancel an order, we will refund the amount collected for the canceled product.

23. Collectible Values

Sports cards and memorabilia may increase or decrease in value.

Past sales, price guides, auction results, population reports, market comparisons, and estimated values do not guarantee a future sale price or investment return.

Ripped Cards does not provide financial, investment, tax, or legal advice.

Products sold by Ripped Cards are collectibles. They are not being offered as securities, financial products, or guaranteed investments.

You are solely responsible for deciding whether a purchase is appropriate for you.

24. Website Accounts

You may be allowed to create an account on the website.

You are responsible for:

Providing accurate information;

Maintaining the confidentiality of your username and password;

Restricting access to your account and devices;

Reviewing activity performed through your account; and

Promptly notifying us of suspected unauthorized activity.

You may not create an account using false information or impersonate another person.

We may suspend or terminate an account that is used fraudulently, unlawfully, abusively, or in violation of these Terms.

25. Acceptable Use

You may not:

Use the website for an illegal, fraudulent, or abusive purpose;

Attempt to gain unauthorized access to the website or another person’s account;

Interfere with the website’s operation or security;

Introduce malware, viruses, malicious code, or disruptive technology;

Use bots, scrapers, crawlers, or automated systems without permission;

Copy or extract website content for commercial purposes;

Submit false billing, identity, payment, shipping, or contact information;

Use a stolen or unauthorized payment method;

Engage in payment fraud, chargeback fraud, return fraud, product switching, or authentication-document switching;

Submit false claims regarding nondelivery, condition, or authenticity;

Impersonate Ripped Cards or another person;

Resell website access;

Harass employees, contractors, customers, or other users; or

Use our content or branding in a misleading manner.

We may restrict or terminate access to the website for violations of this section.

26. Fraud Prevention

We may use reasonable fraud-prevention and order-verification procedures.

We may request additional information before accepting or shipping an order, including confirmation of:

Identity;

Billing information;

Shipping information;

Payment authorization; or

The relationship between the buyer and payment-method holder.

We may cancel an order if requested verification is not provided or if the transaction presents an unacceptable risk of fraud.

27. Chargebacks and Payment Disputes

Please contact Ripped Cards before initiating a chargeback so that we have an opportunity to investigate and resolve the issue.

Nothing in these Terms prevents you from exercising a lawful right to dispute an unauthorized, undelivered, incorrectly charged, or materially misrepresented transaction.

We may provide transaction information to banks, payment processors, carriers, insurers, fraud-prevention providers, collection agencies, or law-enforcement authorities when reasonably necessary and legally permitted.

Such information may include:

Order confirmations;

Payment records;

Account information;

Website-access information;

Customer communications;

Product photographs;

Shipping records;

Tracking information;

Delivery confirmation; and

Return records.

Fraudulent chargebacks, false nondelivery claims, product switching, return fraud, or other deceptive conduct may result in account termination, refusal of future orders, collection efforts, or referral to the appropriate authorities.

28. Intellectual Property

The Ripped Cards website and its original content—including its name, logo, photographs, graphics, videos, text, product descriptions, page designs, and promotional materials—are owned by or licensed to Ripped Cards and are protected by applicable intellectual-property laws.

You may use the website only for personal, noncommercial shopping purposes.

Without prior written permission, you may not:

Copy;

Reproduce;

Republish;

Distribute;

Modify;

Sell;

License;

Display commercially;

Create derivative works from; or

Commercially exploit

any original Ripped Cards content.

Third-party trademarks, card designs, photographs, athlete images, team logos, and other intellectual property remain the property of their respective owners.

29. Reviews and User Content

If you submit a review, testimonial, photograph, comment, message, or other content, you represent that:

You own the content or have permission to submit it;

The content is accurate to the best of your knowledge;

The content does not violate another person’s rights;

The content is not deceptive or misleading;

The content does not contain malware or harmful code; and

The content is not unlawful, threatening, defamatory, harassing, or obscene.

You grant Ripped Cards a nonexclusive, worldwide, royalty-free license to reproduce, display, edit, publish, and use submitted content in connection with our website, social media, advertising, and business operations, subject to applicable privacy law.

We may remove submitted content at our discretion but are not obligated to monitor all user content.

30. Third-Party Websites and Services

Our website may use or link to third-party:

Payment processors;

Shipping carriers;

Grading companies;

Authentication companies;

Social-media platforms;

Marketplaces;

Advertising services; or

Other websites and services.

These third parties operate independently and may have their own terms and privacy policies.

Ripped Cards is not responsible for the content, availability, security, privacy practices, or independent conduct of third-party websites or services.

31. Website Availability

We do not guarantee that the website will always be available, uninterrupted, secure, or free from errors.

We may modify, suspend, restrict, or discontinue any part of the website without notice.

We are not responsible for service interruptions caused by technical failures, internet outages, maintenance, third-party providers, cyberattacks, or events outside our reasonable control.

32. Disclaimer of Warranties

To the fullest extent permitted by law, the website and its content are provided on an “as is” and “as available” basis.

Except for an express promise contained in a product listing or a warranty that cannot legally be excluded, Ripped Cards disclaims all express and implied warranties, including warranties of:

Merchantability;

Fitness for a particular purpose;

Title;

Noninfringement;

Accuracy; and

Uninterrupted availability.

We do not guarantee that:

Every product description will be error-free;

The website will always function without interruption;

Every defect will be corrected;

A collectible will retain or increase its value; or

A third-party grader or authenticator will reach a particular decision.

Some jurisdictions do not permit certain warranty exclusions. In those jurisdictions, these exclusions apply only to the extent permitted by law.

33. Limitation of Liability

To the fullest extent permitted by law, Ripped Cards and its owners, employees, contractors, agents, and representatives will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from:

Your use of the website;

Your inability to use the website;

A product purchase;

A delayed shipment;

A carrier’s conduct;

Loss in collectible value;

A grading or authentication decision;

Unauthorized account access; or

Third-party services.

To the fullest extent permitted by law, the total liability of Ripped Cards arising from a particular product, purchase, or transaction will not exceed the amount you paid to Ripped Cards for that product or transaction.

These limitations do not apply to liability or consumer rights that cannot legally be limited or excluded.

34. Indemnification

To the extent permitted by law, you agree to indemnify and hold Ripped Cards and its owners, employees, contractors, agents, and representatives harmless from third-party claims, losses, liabilities, damages, and reasonable expenses arising from:

Your unlawful use of the website;

Your violation of these Terms;

Your fraudulent conduct;

Content you submit; or

Your infringement of another person’s rights.

This section does not require you to indemnify Ripped Cards for its own unlawful conduct.

35. Governing Law

These Terms are governed by the laws of the State of [STATE], without regard to its conflict-of-law principles.

If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent legally permitted.

The remaining provisions will continue in effect.

38. No Waiver

Our failure to enforce a provision of these Terms does not waive our right to enforce that provision or another provision in the future.

Ripped Cards may assign its rights and obligations as part of a merger, sale, reorganization, transfer of assets, or other business transaction, subject to applicable law.

40. Entire Agreement

These Terms, our Privacy Policy, our Return and Refund Policy, and any additional terms presented during a transaction constitute the entire agreement between you and Ripped Cards concerning your use of the website and purchases made through it.

If a product listing contains terms that conflict with these general Terms, the more specific product-listing terms will govern that particular purchase to the extent legally permitted.
